This TRANSPORTED COOLED SEMEN BREEDING CONTRACT for the breeding season of 2008, is made and
entered into on this ________ day of_____________, 2008, by Orvil & Barbara Christensen, hereinafter designated
BREEDER, and___________________________________ hereinafter designated MARE OWNER. Mare Owner
agrees to breed the mare___________________________________
Breed __________ Reg. #___________ Age ______to the stallion Remembrance’s Bonfire, TWHBEA Reg. #904345,
for a fee of $450.00, four hundred fifty dollars, (a reduced price), for a live foal subject to the following conditions:
1. The breeding fee includes a non-refundable booking fee of $100.00. The total breeding fee of $450.00 plus a
$25.00 fee to transport stallion to the collection facility must be paid in full with a cashier’s check prior to shipping of
semen plus an additional $25.00 transport fee must be paid for any extra shipments that must be made. The Mare
Owner must notify the Breeder of the expected breeding date at least two weeks prior to the actual shipping date.
2. ADDITIONAL FEES: There will be a prepaid Collection/Laboratory fee of $150.00 paid to collection facility prior to
shipping or a credit card given; plus actual shipping expenses for Federal Express at the time shipped.
A credit card is the recommended method of payment to this facility. If paid by check it must be paid 2 weeks
ahead for clearance of the bank (shipping charges estimated). Any shipments to be sent by airline counter-to-counter
service will have additional charges to cover courier and airline charges. Friday Federal Express shipments requiring
a Saturday delivery will have an additional charge.
3. **The collection facility (Ben Gunn Ranches) will ship semen in Equitainers instead of the disposable one-way
containers some farms use, due to their increased reliability and longer holding time unless otherwise instructed by
mare owner to use the disposable ones for which a non-refundable $35.00 (price subject to change) charge will be
applied plus the container must be returned to the facility. Liability for condition of semen upon arrival is the mare
owner’s responsibility if requesting the disposable container...expecially in the heat of summer. Because of the high
replacement costs of the equitainers, a $300.00 refundable security deposit is required prior to shipment if prepaying
with a check and must be paid at least 2 weeks prior for clearance of the bank. Payment will be returned to you upon
the return of the Equitainer to the collection facility at Ben Gunn Ranches.
If the container is “secured” with a credit card there will be no charge made to the card for the container
“unless” the Equitainer is not returned. The Equitainer must be returned to Ben Gunn Ranches within 7
days at the expense of the mare owner, or the refundable deposit is forfeit. It is recommended that the
container be insured for your safety.
4. At this time we will collect and ship any day Monday through Friday with advance confirmation (at least 24 hours
before) by 12:00 noon (Mountain Standard Time) the day before needed. Notification is needed by Saturday, noon
for a Monday collection and shipment. We require you to have your mare ultra sounded at first observation of active
heat cycle in order to provide us with an anticipated collection date. In order to guarantee adequate concentration of
sperm count, the stallion will need to be scheduled for no live covers or collections for 48 hrs. prior to anticipated
collection need.
5. This Contract contains a "Live Foal Guarantee." A live foal is described as a foal that stands and nurses without
assistance. If foal is born dead, there are return privileges for the current season only, providing Breeder is notified
within 14 days and receives a veterinarian’s statement confirming death within a day of birth. If after being
pronounced "safe in foal", the mare should miscarry, abort or prove barren, the Mare Owner has the privilege/option
to rebreed her during the current breeding season, or the following year, 2009 by transported semen scheduled
according to available times open. Any re-breeding may be done on -site for current farm breeding charges.
6. The mare should be in a healthy and sound breeding condition. A copy of registration papers must accompany
breeding fee.
7. Breeder agrees to diligently try to settle the mare, however, if mare fails to settle, for any reason, the mare Owner
will hold Breeder blameless. We ask that if the mare does not get in foal after two semen shipments, the mare owner is
to call us and discuss any problems there may be and have the mare checked for problems that may prevent her
conceiving. We reserve the right to have a vet’s report on a culture or biopsy of the mare. We also reserve the right
to refuse further shipments and will refund all breed fees with the exception of the booking fee or collection/transport
fees. It is the goal of all parties that your Mare get in foal and produce you, the Mare Owner, a live foal with the
first semen shipment.
If it is found that the mare is unable to conceive for any reason and it is requested by the mare owner the breeding fee
(less the $100.00 booking fee and/or collection/transport fees) will be refunded to the mare owner or the mare owner
may substitute another mare in that breeding season.
8. Mare Owner must notify us when the Mare has been checked for pregnancy. We require ultrasound examination at
16 days after insemination and again at 24-35 days to ensure pregnancy.
9. A Breeding Certification in the form of a signed foal registration form will be issued for the foal, conceived by this
mating, when mare has produced a live foal from this mating.
10. It is further agreed that the stallion is warranted free from disease as of this date and that should the stallion die or
become unfit for service prior to fulfilling this contract, this contract becomes null and void. Any prepaid breeding fee
will be refunded at that time. No collection or transport fees will be refunded if already incurred and mare did not
conceive. If the mare should die or become unfit to breed prior to fulfilling this contract, the Mare Owner may
substitute another mare or request a refund of the breeding fee less the booking fee and any incurred transport fees
of the stallion.
11. This Contract is non-assignable and non-transferable.
12. This Contract is entered into in the State of Idaho and will be interpreted and enforced under the laws of that
state. Should either party breach this contract, the breaching party shall pay for the other’s court cost and attorney
fees related to such default. The forum for any litigation regarding this contract will be in Bingham County, Idaho.
14. This Contract represents the entire agreement between parties. No other agreements or promises, verbal or
implied, are included unless specifically stated in this written Contract.
When Mare Owner and Breeder sign this Contract, it will be binding on both parties, subject to the above terms and
conditions.
Fees due with signed contract:
Breeding fee: $450.00 ($100.00 non-refundable)
Collection/Laboratory fee: $150.00 (this is a direct, third-party fee passed along to mare owner for collection
and processing)
Stallion Transport fee $25.00 (Bonfire to a collection facility, non-refundable)
Overnight Shipping charges: to your selected location is based upon actual costs.
**Refundable security deposit on Equitainer $300.00 if not secured by a credit card.
**Non-refundable $35.00 (subject to change) charge on disposable container if requested.
